1. How does a patent transaction work?

Confirm the patent price and notify us of your intent to purchase by clicking "Buy" to proceed with the transaction. We'll send you a standard patent sales contract. After signing, please deposit the purchase price within three days.

2. What is the process for registering a change in patent ownership?

After signing the standard patent sales contractand depositing the money, we will register the transfer of ownership with theKorean Intellectual Property Office (KIPO). Registering the change in ownershipwith the Korean Intellectual Property Office (KIPO) takes approximately 2-3days, and we charge a registration fee and viewing fee.

3. What are the transaction fees?

If you purchase a flat-rate domestic patent, there is no brokerage fee for the buyer, but only a 9% commission is charged to the seller. However, the minimum commission is 500,000 KRW.

If you purchase a negotiated price patent, the buyer receives a 10% commission and the seller receives a 15% commission. For international patents, if the patent is a flat-rate patent, the buyer receives a 5% commission and the seller receives a 12% commission. If the patent is a negotiated price patent, the buyer receives a 12% commission and the seller receives a 17% commission. If you purchase a family of patents registered both domestically and internationally, you will be charged a foreign patent fee.

4. Can I purchase bundled patents individually?

Bundled patents are usually patents with the same inventor, such as those from the same professor or lab at a university. In these cases, because they cover a series of technologies, they are often sold as a bundle. They can be sold individually, but discounts only apply to bundled purchases.

5. This is a Korean patent that was later filed for PCT and registered in the US. Can I purchase only the Korean patent?

Patents registered in other countries, such as the US, Europe, and China, through PCT cannot be purchased individually; they can only be sold as a whole. This is to prevent confusion in exercising patent rights due to different national owners of the same patent technology.

6. Can I purchase a patent that isn't on the patent listing?

If you'd like to purchase a patent in a desired technology area other than the listed listing, you can inquire through the Purchase Inquiry form. Patent sourcing will begin after a deposit of 300,000KRW is deposited, and the deposit will be deducted from the final brokerage fee. The brokerage fee is 20%.

7. Can I cancel the sales contract?

The standard patent sales contract is signed by the seller and then the buyer. If the buyer hasn't signed the final contract, the contract can be canceled. However, after the buyer has signed the final contract, cancellation due to a change of mind is not possible.

8. Can I get a refund?

No refunds are available after the standard patent sales contract is signed and the purchase price is paid.

9. The brokerage fee is listed as the lowest in Korea. How can you guarantee it?

If another company has posted a lower brokerage fee online for the same patent, we will refund the difference.

10. Is the patent being sold still registered?

When registering patents, our company only lists patents that are still active and have paid the required annuity fees. However, since patent maintenance fees must be paid annually based on the patent registration date, we occasionally encounter cases where patents were still active when they were registered, but the due date for payment has passed. In such cases, we verify the registration status before signing the standard patent sales agreement to prevent patents that have become ineffective due to non-payment of annuity fees from being traded.

11. Who is responsible for the patent registration maintenance fee?

For domestic patents, the maintenance annuity fee is payable annually after three years from patent registration. If the standard patent sales agreement is signed within 10 days of the annuity payment due date, the transferor pays the fee.

If the payment due date is exceeded, you can still pay the annuity fee for up to six months, with a late fee.

12. When does legal ownership of a foreign patent arise?

Generally, signing a patent sales agreement and paying the fee will result in legal ownership being recognized in most countries. For US patents, registering a change in ownership is not mandatory. However, if filing a patent infringement lawsuit in the US, registering a change in ownership with the US Patent and Trademark Office can reduce legal risk by eliminating the need to prove ownership in the event of litigation. This also applies to German patents.

13. I'm planning to purchase a foreign patent. Can I directly file a change in ownership with the foreign patent office after signing the patent sales agreement?

If you have a patent office or law firm you work with, you can register the change in ownership yourself. However, as a courtesy to our customers, Intellectual Bridge can handle this for a fee.

14. How long does it take to register a foreign patent after filing a change in ownership with the relevant country's patent office?

Each country has different work styles and cultures, so there are differences. For the US Patent Office, it takes about 3 days to 6 weeks from the date of application filing, for the German Patent Office, it takes about 2 to 6 weeks, and for the Chinese Patent Office, it takes about 1 to 2 months.
